These Terms cover one part of Fetti Up: trip photo albums, called the Roll, and the comments people leave on those photos. They set the rules for what you can upload and write, our zero-tolerance policy on abusive content, and how a photo or a comment gets removed.
Upload photos you have the right to share, of people who agreed to be photographed and to appear in a shared trip album.
We do not allow child sexual abuse material. We remove it on discovery, preserve what the law requires, and report it to NCMEC.
We act on every report within 24 hours, and remove nonconsensual intimate imagery within 48 hours of a valid request.
These Terms apply to the Roll, the shared photo album on a Fetti Up trip, and to the comments trip members leave on those photos. They do not replace the Fetti Up Privacy Policy, which explains what account and bill data we store; these Terms are specifically about the photos and comments you and other trip members add.
You accept the version of these Terms shown in the app before your first photo upload on a device, and again whenever we publish a new version. Every upload is checked against the version you accepted; an upload made against an older version is not accepted until you agree to the current Terms.
Only upload a photo you took yourself, or one you otherwise have the right to share.
Only upload a photo of people who agreed to be photographed and to appear in a trip album that other trip members can see.
Do not upload anything illegal to possess, create, or share.
Comments are part of the album. Do not post anything harassing, threatening, or illegal, and do not use a comment to share someone else's private information.
Any sexual content involving a minor, in any form. See Child sexual abuse material below.
An intimate or sexual photo of someone shared without their consent. See Nonconsensual intimate imagery below.
A photo you were not permitted to share, or that infringes someone else's copyright or other rights.
Content meant to harass or threaten a real person, and anything else illegal to possess or distribute. This applies to comments as well as photos.
Fetti Up has zero tolerance for child sexual abuse material (CSAM) of any kind. We remove it as soon as we become aware of it, preserve what 18 U.S.C. 2258A requires us to preserve, and report it to the National Center for Missing & Exploited Children (NCMEC).
Uploading CSAM is illegal. We remove the content, cut off the link it came from, and remove the account if there is one. We also report what the law requires to NCMEC and law enforcement.
If an intimate or sexual photo of you was shared without your consent, tell us at hello@fettiup.com. We remove nonconsensual intimate imagery within 48 hours of a valid request, consistent with the federal TAKE IT DOWN Act, which the FTC enforces. You do not need to identify who uploaded it before we remove it.
Every photo and every comment in a trip album has a Report action in the app. You can also email hello@fettiup.com with a link to the trip, or a description of the photo, and why it should come down.
We act on every report within 24 hours.
We may remove a photo, disable photo posting on a trip, or remove access to a trip or account, if these Terms are violated. Content that is illegal is reported to the appropriate authorities.
Fetti Up is not directed to children under 13, and the Roll is not a place for photos of children uploaded without a parent or guardian's consent.
If we change these Terms, we update the date and version below and post the new version here. The version you accepted travels with every upload, so a change never applies to a photo you already added.
